- The assignment is an assignment with a fixed and a conditional part. These are referred to as phase 1 and phase 2 in the plan bundle. The submitter is obliged to submit a price for all parts of the fixed part as well as for all parts of the conditional part. The vasHowever, the client's obligation is limited to solely the fixed portion after award. The client reserves the right not to order the conditional part and, if necessary, the submitter cannot claim compensation for the failure ton any order regarding the conditional part. In any case, the execution of the conditional part will only be made possible by the client's provisional acceptance of the fixed part and the obtaining of the necessary budget. Verilypart will be ordered by notification. The execution of the assignment takes place in phases. This assignment therefore consists of a fixed part and a conditional part, whereby the execution of the conditional part is made dependent on the separate official orders.decision of the client, in particular ERF, insofar as the owner, namely the local government of Diest, makes a unanimous decision in this regard. The client thus reserves the right to terminate this assignment after execution of the fixed part and only undertakes to do sountil the fixed part after the award of this contract. General assignment description for both permanent and conditional parts: Urgent conservation works on the facades of courtine and tenaille 3 and 4 and bastion 3, 4 and 5 as delineated on the plans and facade elevations. Fixed part of the assignment:The tasks within this assignment include: The facades of Tenaillegracht 3 and 4 and bastion 3, 4 and 5 Conditional part of the assignment: Under certain conditions, the contractor will also carry out the second phase of the assignment. The conditions are the following: • The absence of defectand in the execution and result of the first phase of the assignment, being the permanent part of the assignment; • the availability of the necessary financing to carry out the assignment; • the (policy) vision on the use of the heritage of the city of Diest. If one of the conditions is not methas been met, the client may decide that the contractor may not commence the second phase of implementation. The conditional part includes at least the following tasks: Facades of Block 2, 3, 4 and 5 on Terreplein, facades of Block 3 and 4 on Tenaillegracht and the facades of Bastion 3, 4 and5
