This research focuses on the legally secure and flexible anchoring of the rapidly evolving environmental policy within the Flemish Region, based on advancing scientific insight. Two pillars are central: on the one hand an international benchmark and on the other hand a case study. The purpose of the benchmark is to gain insight into the instruments (may be broader than permits) or techniques (regulatory or not) that other representative Member States or regions use to achieve the same objectives as those of Title II of the VLAREM, namely the prevention or limitation of unacceptable nuisance and risks arising from operations, and the positive and negative elements that are experienced, such as complexity. The purpose of the case study is to investigate how unacceptable nuisance and risks for ZS can be limited by legally anchoring a Flemish ZS policy. The research should provide insights, including on the basis of a comparative legal study, into how flexible and legally certain environmental standards or conditions can be anchored, taking into account, among other things, the standstill principle. VLAREM's benchmarking offers a broad perspective, while the ZS lists case study shows how policy priorities that are subject to rapid evolution can be concretely translated into standards or legally enforceable frameworks.
