Description:
This market has gone through competitive procedure with negotiation, in accordance with article 38, §1er, 1 of the law of June 17, 2016 relating to public contracts in that:
A. Justification in law:
The use of the PCAN is justified under article 38, §1er, 1 of the law:
c) the market cannot be allocated without preliminary negotiations due to specific circumstances linked to its nature, its complexity or legal and financial assembly or due to the risks attached to it.
d) The contracting authority is unable to define technical specifications with A sufficient precision by referring to a standard, a European technical assessment, a common technical specification or a technical reference within the meaning of article 2, 45 to 48 .
This procedure is adapted to the complex nature of insurance services which does not make it possible to define with a Sufficient precision The technical specifications of the guarantees as soon as the procedure is launched.
The European directive 2014/24/EU of February 26, 2014 intends to promote the use of competitive procedure with negotiations (see the recitals 42 and following and article 26 of the Directive).
