Description:
Article 48 of the Flemish Enforcement Framework Decree (KVH) of 14 July 2023 provides for actual recovery of public damage as well as, under certain conditions, for financial equivalent recovery. The possibility of recovery with a financial equivalent is a new fact in the context of environmental enforcement. Public damage is defined in Article 2, 24° KVH as the irregularities that constitute or result from the crime, infringement or violation of standards, and the public losses associated with those irregularities. The Flemish Government can determine further rules for the monetary valuation of the public damage that will in fact remain unrepaired. This tradition does not yet exist for damage to interests protected by environmental regulations, which is why no formal rules are currently laid down in the Decree of the Flemish Government of 23 May 2025 on environmental enforcement (hereinafter: Environmental Enforcement Decree).
