- The purpose of this concession is to operate the restaurant at the Palais des Beaux-Arts. The premises are conceded for the operation of a restaurant (the "restaurant") open to visitors and to the general public as well as to the concedent staff and to the guest artists. The restaurant will havevocation to be a gastronomic restaurant. The concedent:-provides the concessionaire with the occupation of the premises located on the ground floor (242.3 m2), in mezzanine (surface limited to 49.1 m2) and in the basement (197.5 m2), located in the Palais des Beaux-Arts, in 1000 Brussels, rue BaronHorta 3, for the purpose referred to in this specifications (estimated area before development). and - gives the exclusivity referred to in point II.21.5. The nature of the concession contract excludes any otherCivil or commercial contract and more particularly, any commercial lease. This qualification explains and justifies that the service conceded remains subject to the laws of public service (primacy, change, continuity, equality, etc.) and the control of this public service by the administration. THEPrinciple of execution of good faith must be appreciated here more particularly with regard to missions of general interest and public service which is invested in the Palais des Beaux-Arts.
